Terms of Service

IMPORTANT: PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY CREATING AN ACCOUNT, ACCESSING, OR USING THE VIBELINK APPLICATION OR WEBSITE (COLLECTIVELY, THE "SERVICE"), YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE ("TERMS"). IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.
1. Eligibility
You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement.
2. Account Registration
You must create an account through a supported third-party authentication provider (currently Google, Apple, or Meta). By registering, you agree to:
- Provide accurate, current, and complete information
- Maintain the security and confidentiality of your login credentials
- Notify VibeLink immediately at contact@vibelinkapp.com of any unauthorized access
- Accept full responsibility for all activities under your account
- Refrain from creating more than one account per person
Accounts are personal and non-transferable.
Identity verification. During onboarding you must complete a liveness selfie check, which compares a live selfie against your profile photo to confirm that you are a real person and that the profile is your own. Completing this check is a condition of using the Service. See our Privacy Policy for how the selfie is stored and retained.
Banned accounts may not re-register. If your account is permanently banned, you may not create a new account. To enforce this, we retain irreversible one-way hashed identifiers derived from the sign-in identity and the phone number associated with the banned account. These hashes cannot be reversed to recover the original values; they are used only to detect and block re-registration attempts.
3. Fees
VibeLink is currently offered free of charge. There are no subscription fees, no free-trial period, and no in-app purchases. If we introduce paid features in the future, we will update these Terms, publish the pricing and cancellation terms before any charge is made, and notify you in advance in accordance with Section 14.
3.1 Vibes Are Free to Attend
Vibes are free to attend. VibeLink is a way to organize gatherings, not a way to sell access to them. You must not charge, request, or accept payment from another user as a condition of their joining or attending a vibe, including admission fees, ticket sales, cover charges, or deposits. Accounts used to sell access to vibes may be suspended or permanently banned.
4. Acceptable Use
You agree not to use the Service for:
- Any unlawful, harmful, fraudulent, or abusive purpose
- Harassment, stalking, bullying, intimidation, or threats of violence
- Impersonation or misrepresentation of your identity
- Creating fake, misleading, or catfishing profiles
- Posting hateful, discriminatory, defamatory, or sexually explicit content
- Unauthorized access to or disruption of the Service
- Commercial solicitation without prior written consent
- Doxing — publishing or threatening to publish another person's private information (such as their home address, workplace, phone number, or other identifying details) without their consent
- Spam or unsolicited bulk messaging, including sending repeated unwanted messages or invitations
- Using bots, scrapers, or automated tools
- Using Service data to train AI models without written consent
- Reverse engineering any part of the Service
Violations may result in content removal, suspension, or permanent termination.
4.1 Vibes Are Gatherings, Not Listings
VibeLink exists so that people can meet other people. A vibe must be a real gathering that you are organizing and intend to attend yourself. You must not create a vibe in order to advertise, promote, or drive signups or ticket sales to an event, listing, or page hosted elsewhere, including on ticketing or event-listing platforms, and you must not use a vibe to redirect people to another platform or service. Deciding as a group to attend something happening publicly is fine; creating a vibe whose purpose is the link is not. Vibes created for this purpose may be removed, and the accounts behind them suspended or permanently banned.
4.2 Reporting and Enforcement
You can report a user, a vibe, a message, or a comment directly in the app using the report option on that item. Reports are reviewed by our moderation team.
Where a report is substantiated, or where we otherwise identify a violation of these Terms, we may remove the offending content, suspend the account temporarily, or permanently ban the account, depending on the severity and history of the violation. We may also take these actions on our own initiative without a report having been filed.
Where we take enforcement action against your account, we will make reasonable efforts to notify you by email at the address associated with your account. Notification is best-effort and is not a condition of enforcement.
5. User-Generated Content
5.1 Ownership
You retain ownership of all content you post ("User Content").
5.2 License Grant
By posting User Content, you grant VibeLink a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, distribute, display, and perform such content in connection with operating and promoting the Service. This license ends when you delete your content or account.
5.3 Content Responsibility
VibeLink does not endorse or verify any User Content. You are solely responsible for what you post. VibeLink reserves the right to remove content that violates these Terms.
5.4 Records Tied to a Vibe
When you delete your account, your personal information is purged as described in our Privacy Policy. Some activity records tied to a vibe — for example messages you sent in that vibe's group chat and the record of your participation in it — remain associated with the vibe after your account is gone, so that the vibe stays coherent for the other people who took part. Those records are deleted when the vibe itself is deleted.
6. Safety and Real-World Interactions
VibeLink facilitates connections. We run the liveness selfie check described in Section 2 to confirm that an account belongs to a real person, but we do not conduct criminal background checks, identity-document verification, or any other vetting of users, and passing the liveness check says nothing about whether a person is safe or trustworthy. You acknowledge that:
- You assume all risks associated with interactions with other users
- You are solely responsible for your own safety
- VibeLink is not a party to any arrangement between users
- You will take reasonable precautions when meeting others
VibeLink is a coordination tool: we help you find and organize gatherings, and nothing more. Whether you meet another user in person is entirely your own choice, and anything that happens between users away from the Service — including at a vibe — is outside our control and outside our responsibility.
7. Intellectual Property
The Service and all its content are the exclusive property of VibeLink, protected by Canadian and international intellectual property laws. You receive a limited, non-exclusive, revocable license for personal, non-commercial use.
8. Privacy and Data Protection
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms. VibeLink does not sell your personal data and complies with PIPEDA.
9. Termination
9.1 By You
You may terminate your account at any time through app settings or by contacting contact@vibelinkapp.com.
Deleting your account starts a 30-day recovery window. During that window you can restore the account by signing back in. If you do not, your account and the personal information associated with it are permanently purged at the end of the window and cannot be recovered. See our Privacy Policy for the full retention schedule.
9.2 By VibeLink
VibeLink may suspend or terminate your account for violations of these Terms or for any reason at our sole discretion. Inactive accounts may be terminated after 12 months with prior notice.
Severe violations may be terminated immediately and without prior notice. These include child sexual abuse material, credible threats of violence, and content depicting or facilitating imminent harm to any person.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. VIBELINK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. YOUR PARTICIPATION IN ANY ACTIVITY ORGANIZED THROUGH THE SERVICE IS AT YOUR OWN RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBELINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. VIBELINK'S TOTAL LIABILITY SHALL NOT EXCEED CAD $100.
Some jurisdictions — including certain European Union member states and certain United States states — do not permit the exclusion or limitation of some warranties or liabilities. Where you are located in such a jurisdiction, the exclusions and limitations above apply to you only to the extent permitted there, and our liability is limited to the minimum permitted by the applicable law.
12. Indemnity
You agree to indemnify and hold harmless VibeLink from claims arising out of your use of the Service, your content, your violations of these Terms, or your interactions with other users.
13. Governing Law and Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of Ontario and federal Canadian law.
13.2 Jurisdiction
Ontario courts have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the Service.
14. Changes to Terms
VibeLink may modify these Terms at any time with at least 14 days' notice. Continued use after changes take effect constitutes acceptance.
Where a change is material, we will notify you by email at the address associated with your account, using our standard Terms-update notice, in addition to updating the revision date at the top of this page.
15. Severability and Entire Agreement
If any provision is held invalid, the remaining provisions continue in full force. These Terms, together with the Privacy Policy, constitute the entire agreement.
16. Waiver
Failure to enforce any provision does not constitute a waiver. Any waiver must be in writing.
17. Third-Party Services and App Stores
17.1 Third-Party Integrations
The Service integrates with Google, Apple, Meta, X, and LinkedIn for authentication. Your use of third-party services is subject to their terms.
17.2 App Store Terms
If you downloaded the Service from an app store, these Terms are between you and VibeLink. The app store provider has no obligation regarding the Service but is a third-party beneficiary of these Terms.
18. Force Majeure
VibeLink is not liable for failures beyond our reasonable control, including natural disasters, pandemics, war, government actions, infrastructure failures, or cyberattacks.
19. Geographic Availability
The Service is intended primarily for use in Canada. Access from outside Canada is at your own risk.
