VibeLink Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the VibeLink mobile application and related services (“Service”) provided by VibeLink (“we,” “our,” or “us”). By accessing or using the Service, you agree to be bound by these Terms.
- ELIGIBILITY
The Service is intended for individuals who are at least 18 years old or the age of majority in their jurisdiction. By using the Service, you affirm that you meet this requirement. If you do not meet this requirement, you may not use the Service.
- ACCOUNT REGISTRATION
To access certain features, including premium features, you must create an account using a third-party login provider such as Google, Meta (Facebook), or Apple. By registering, you agree to:
- Provide accurate, current, and complete information linked to your third-party login.
- Maintain the security and confidentiality of your account and associated credentials.
- Notify us immediately of any unauthorized use of your account.
- Accept full responsibility for all activities that occur under your account.
- Not sell, transfer, or share your account with others. Your account is personal and non-transferable.
- FREE TRIAL AND SUBSCRIPTION
We offer a 7-day free trial for new users. You will not be charged if you cancel within the trial period. If you continue using the Service after the trial, you authorize us to charge your payment method for the applicable subscription fee.
The premium plan offers three tiers:
- Monthly (recurring)
- 6-Month (one-time payment)
- Yearly (recurring)
Recurring plans auto-renew unless canceled at least 24 hours before the renewal date. You may cancel your subscription at any time through your account settings or the applicable app store. We will send you a reminder at least 3 days before your subscription is set to renew. Fees are non-refundable after the trial period, except as required by law. No partial refunds will be issued for unused periods.
All prices are listed in Canadian dollars. Applicable taxes may be included or added at checkout, depending on the payment platform.
- ACCEPTABLE USE
You agree not to:
- Use the Service for any unlawful, harmful, or abusive purpose.
- Harass, stalk, threaten, or harm others.
- Impersonate any person or entity, or misrepresent your identity.
- Post or transmit content that is hateful, discriminatory, violent, sexually explicit, or otherwise objectionable.
- Attempt to gain unauthorized access to or interfere with the Service or its security.
- Use the Service for commercial solicitation without our prior written consent.
- Circumvent premium features by including demographic preferences (e.g., gender, religion, age) in activity titles or descriptions unless using a premium feature designed for that purpose.
Activity Posts that include discriminatory, misleading, or inappropriate content are subject to removal at our discretion. Repeated violations may result in account suspension or termination.
4A. USER-GENERATED CONTENT
Users retain ownership of the content they post, including activity descriptions, photos, and other submissions (“User Content”). By posting User Content to the Service, you grant VibeLink a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and improving the Service.
We do not endorse or guarantee the accuracy, quality, or legality of any User Content. You are solely responsible for your User Content. We reserve the right to remove or restrict access to any content that violates these Terms, applicable laws, or community standards, without notice.
- SAFETY AND REAL-WORLD INTERACTIONS
You are solely responsible for your interactions with other users. We do not conduct background checks or verify the identity of users. By participating in in-person activities, you assume all risks associated with such interactions, including the risk of injury, illness, or other harm. We encourage you to use good judgment and take appropriate precautions.
- INTELLECTUAL PROPERTY
The Service, including its content, trademarks, and technology, is owned by VibeLink or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
- PRIVACY
We collect and use your personal information in accordance with our Privacy Policy. By using the Service, you consent to our data practices. We do not sell your personal data to third parties. We encourage you to review our Privacy Policy for more information.
- TERMINATION
You may terminate your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or misuse the platform. Upon termination, your license to use the Service ends immediately.
- DISCLAIMERS
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We make no warranties regarding the quality, safety, or accuracy of any activities or content posted by users.
Participation in any activity listed on the Service is entirely at your own risk. We disclaim all liability for any injury, loss, or damage resulting from user interactions or activities.
- LIMITATION OF LIABILITY
To the extent permitted by law, VibeLink shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Service. Our total liability to you for any claims under these Terms shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.
- INDEMNITY
You agree to indemnify, defend, and hold harmless VibeLink and its affiliates, officers, directors, employees, contractors, licensors, and partners from any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to:
- Your use of the Service;
- Your violation of these Terms;
- Your violation of any applicable law or third-party rights; or
- Your User Content.
- GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada.
Optional Arbitration: You may choose to resolve disputes with us through binding arbitration instead of court. This is voluntary and does not affect your right to pursue claims through the court system.
- CHANGES TO TERMS
We may update these Terms from time to time. If we make material changes, we will update the “Effective Date” above and provide notice via the Service or email. Continued use of the Service after changes indicates your acceptance. If you do not agree, you must stop using the Service and delete your account.
- SEVERABILITY AND ENTIRE AGREEMENT
If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. These Terms, along with our Privacy Policy, constitute the entire agreement between you and VibeLink regarding the Service.
- WAIVER
No waiver by us of any breach of these Terms shall be deemed a waiver of any subsequent breach. Failure to enforce any part of these Terms does not constitute a waiver of our rights.
- THIRD-PARTY SERVICES
The Service may integrate with or use services provided by third parties such as Google, Apple, or Meta. VibeLink is not responsible for these third parties, and your use of their services is subject to their terms and privacy policies.
- MODIFICATION OF SERVICE
We may modify, suspend, or discontinue any part of the Service at any time without notice. We are not liable for any changes that affect availability, functionality, or user access.
